Team Obama has made much of the concept of “prosecutorial discretion.” In fact, the administration has mutated the Constitution by claiming that any law it doesn’t like – for example, our immigration statutes – can be effectively rewritten by refusing to prosecute those who violate them.

Yesterday, Team Obama decided to prosecute Democratic Senator Robert Menendez, over longstanding allegations of corruption. Why did he get the book thrown at him now by a Justice Department notorious for using its discretion to protect – not pursue – presidential cronies, contributors and political allies?

Whatever the merits of the charges, Sen. Menendez appears to have incurred the administration’s wrath by objecting to its appalling foreign policy concessions to Iran and Cuba. The message is unlikely to be lost on others who know they should oppose Obama’s dangerous appeasement.
